1. Agreement to Terms

By accessing or using Free App Maker ("Service"), operated by Free App Maker ("we", "us", "our") at freeappmaker.pro, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.

2. Description of Service

Free App Maker is a website-to-app builder platform that enables users to convert websites into native mobile applications (Android APK/AAB). The Service includes:

• A web-based app configuration interface
• Cloud-based mobile app build infrastructure
• AI-powered website analysis for automatic configuration
• Game templates powered by third-party game providers
• Ad monetization integration (AdMob)
• Downloadable build artifacts (APK, AAB files)

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent or abusive purposes.

4. Plans & Pricing

The Service offers free and paid plans. Free plans have limited daily build quotas and produce debug-signed APK files. Paid plans unlock additional features including higher build limits, store-ready (AAB) builds, and publishing assistance.

Prices are listed on our Pricing page and may change at any time. Existing purchases are not affected by price changes.

5. Payments & Merchant of Record

All paid plan purchases are processed through a third-party payment provider that acts as the Merchant of Record for all transactions. This means:

• The payment provider is the legal seller of record for your purchase
• The payment provider handles payment processing, tax compliance, and chargebacks
• Your payment method is processed directly by the payment provider — we never see or store your full card details
• The payment provider's buyer terms of service apply to your purchase in addition to these terms

By making a purchase, you also agree to the applicable buyer terms of the payment provider used at checkout.

6. Refund Policy

Since the Service delivers digital products (compiled mobile applications), refunds are handled on a case-by-case basis. If you experience a technical issue that prevents delivery of your build, contact us within 7 days for a resolution. See our dedicated Refund Policy page for full details.

7. Acceptable Use

You agree not to use the Service to:

• Build apps that infringe on the intellectual property of others
• Wrap websites you do not own or have permission to use
• Create apps that contain malware, spyware, or malicious code
• Distribute apps that violate Google Play Store or Apple App Store policies
• Use the Service for illegal activities or to promote violence, hate, or discrimination
• Attempt to reverse-engineer, exploit, or overload our infrastructure
• Resell access to the Service without written authorization
• Create apps that deceive users or misrepresent their purpose

We reserve the right to remove any app or terminate any account that violates these terms without notice.

8. Intellectual Property

8.1 Your Content

You retain full ownership of the websites, assets (icons, images), and configurations you provide to the Service. By using the Service, you grant us a limited license to process your content solely to deliver the Service (building your app).

8.2 Our Platform

The Service, its interface, branding, and underlying code are owned by Free App Maker. You may not copy, modify, or redistribute our platform.

8.3 Generated Apps

The compiled apps we generate for you are yours to distribute, publish, and monetize. We do not claim ownership over your generated APK/AAB files.

9. Third-Party Services

The Service integrates with third-party providers including but not limited to Supabase (authentication/database), our own build pipeline (cloud builds), Cloudinary (image storage), third-party payment providers (payments), Google AdMob (ads), and Gamezop (game content). Your use of these services is subject to their respective terms.

We are not responsible for the availability, accuracy, or conduct of third-party services.

10. Game Templates

Game templates available on our platform are provided by third-party game providers (Gamezop). Games are monetized through the provider's ad network. Revenue generated from game apps may be withdrawn according to the terms described on our platform. We do not guarantee any specific revenue from game apps.

11. Service Availability & Limitations

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Build times may vary depending on server load. Daily build limits are enforced per plan as described on our Pricing page.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED. WE DO NOT GUARANTEE THAT GENERATED APPS WILL BE ACCEPTED BY ANY APP STORE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREE APP MAKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Free App Maker from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.

15. Termination

You may terminate your account at any time by contacting support. We may terminate or suspend your access immediately, without prior notice, for conduct that violates these terms or is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of the United States.
